What do we do?
We provide notarial practice services for businesses and individuals including attesting documents such as affidavits, statutory declarations, powers of attorney, contracts, and other documents, and certification of their due execution for use overseas.

It is a common misunderstanding that notarisation of a document is simply witnessing a signature. This is not the case as we are certifying the document and need to be satisfied of the identity of the person signing the document and that, where signing on behalf of a company, the person has the authority to sign the document.

We will require you to provide documents to show you have the necessary authority where a document is being signed on behalf of a company. Please ensure that you have these documents available if you are signing on behalf of a company. You will also need to consider whether you need two directors to sign or a director and a company secretary if you intend to bind the company. All directors will need to sign in front of the notary and provide identification documents including original passports and driving licence.

It is also important that you have checked the document you provide to us as we are not signing to the truth of the content of the document but the identity of the signatory and authority. We are not responsible where there are subsequent errors in the documents you have signed. It is up to you to ensure the document is in the form that you are prepared to sign. This is not the notary’s responsibility.

Please note that we do not accept responsibility for the validity of documents prepared for use outside Australia, their acceptability, or consequences that may arise from the use of these documents. You must make enquiries with local lawyers to ensure that you have met the requirements of the country where the documents will be used.

Hours of Operation
By appointment only. We provide an after hours service in the evening or weekend for no additional cost. We will also attend your premises if this is easier for you. Depending whether the premises are located there may be an additional attendance fee for this service.

What do you need?
You will need to bring your passport and driving licence with you to your appointment as well as any documents to establish authority if you are signing on behalf of a company.

It is also helpful if you can email a copy of the document that you require to be notarised to us in advance of the appointment and any document prepared by your overseas lawyer prior to your appointment.

If you have large documents we will outsource the copying of your documents and there will be an additional cost charged to you as an out of pocket expense. It is of course open to you to arrange the copying of larger documents at a local printer close to you.

What next?
You should check whether the recipient of the document requires it to be legalised by DFAT with an apostille or legalisation. We can arrange this for you.
